HOMEOWNERS ASSOCIATION (HOA) and CONDO OWNERS ASSOCIATION (COA)


Florida Statutes govern HOAs and COAs. These associations have the power to establish covenants and procedures for how the community is operated while also having authority to impose dues, assessments and even fines on owners within the community. 

Failure by an owner to pay these dues timely can result in the association recording a lien on the owners property. If such lien is found to be valid and enforced it may result in a foreclosure on the home or condo unit if not paid off. 

Often times residents will find themselves in a dispute with their HOA or COA over fines or other methods of HOA/COA enforcement of their covenants. Many of these disputes require that the owner and association participate in non-binding arbitration or mediation prior to filing a lawsuit.
